1. Scope

These terms of use govern the use of Volley Vendetta (volleyvendettamanager.com), operated by Spike-Set-Serve (Lukas Widmer). Volley Vendetta is a free browser game developed and run by a single person in their spare time. Features and availability may change at any time. Voluntary donations are possible; they unlock nothing, details are in section 14.

The disclaimer and the privacy policy form part of these terms of use. Where the texts contradict each other, whichever is more favourable to you applies.

2. Account and minimum age

By registering you confirm that you are at least 16 years old. An account is personal and not transferable. You are responsible for the security of your own password.

There is no entitlement to an account. The operator may refuse to open one and may suspend or delete an account for serious or repeated breaches. You can delete your account yourself at any time; what happens to your data is set out in the privacy policy.

3. Virtual in game cash

The cash used in the game (shown with the abbreviation CHF) is a purely virtual, in game unit with no real monetary value. It is earned solely through gameplay, for instance through wages, home match income or player sales, and can neither be bought with real money nor exchanged or paid out. Labelling it CHF is purely cosmetic and creates no monetary claim.

There is no entitlement to the preservation of save states, in game currency, cards or achievements. Game content may be changed, reset or removed as development continues, for instance to balance the game or correct a fault.

4. Challenges: stakes and tournaments

The challenges feature, meaning duels with a stake and tournaments with an entry fee and prize pool, moves only virtual in game cash between teams inside the game. At no point is real money staked, paid out or exchanged. This closed system is deliberate and will not be extended with a real money component.

5. Fair play and house rules

The following are prohibited in particular: exploiting program faults for your own gain, multiple accounts to circumvent game mechanics, moving in game currency or cards between accounts acting in concert, automated access by bots or scripts, and insulting, threatening, discriminatory or harassing behaviour towards other players.

Breaches may lead to warnings, restrictions or suspension of accounts, and unlawfully obtained in game currency and cards may be reset. If you find a fault, please report it rather than exploit it.

6. Limitation of liability

Volley Vendetta is provided free of charge and as is. There is no entitlement to uninterrupted availability, to freedom from faults or to the permanent preservation of game progress. Liability for damage arising from use of the game is excluded to the extent permitted by law.

This does not affect liability for intent and gross negligence, liability for damage arising from injury to life, body or health, or any further liability that cannot be excluded by law.

7. Intellectual property

All content of the application is protected by copyright. Trademarks, club names and competition names belong to their respective owners. Further detail is in the imprint.

8. User content and image rights

When you upload an image, meaning a team logo, a profile picture or a card image, you grant the operator a free, worldwide, unlimited and transferable licence to use that image to run and promote the game. At the same time you confirm that you hold the necessary rights and that you are not depicting any other person without their consent. It also matters that an image visible in a browser can be photographed and redistributed by others; there is no effective technical means against that.

The full conditions, the handling of images of real people and the reporting route for those affected are set out in the disclaimer. It forms part of these terms of use.

9. Data protection

Which data arises while you play, who can technically see it, how long it stays and what rights you have is set out in full in the privacy policy. In short: no tracking, no advertising, no selling of data, and no artificial intelligence processing what you enter.

10. Governing law and jurisdiction

Swiss law applies, excluding its conflict of law rules. The place of jurisdiction is, as far as legally permissible, the operator's domicile. Mandatory consumer protection provisions of your country of residence remain unaffected.

11. Severability

Should any provision of these terms of use be or become wholly or partly invalid, the validity of the remaining provisions is unaffected. The statutory rule takes the place of the invalid provision.

12. Changes and language versions

These terms of use may be adjusted where needed, for instance when new features arrive. The version published on this page at the time of use is the one that applies. For substantial changes it is pointed out in the in game news as well.

The German version is authoritative. Translations into other languages serve comprehension and create no differing rights or obligations.

14. Donations

Donations are voluntary and are not a requirement for using the game. The game is and remains fully usable free of charge. A donation unlocks no feature, grants no advantage in the game and provides neither game currency nor cards, boosts or other game content. Section 3 applies unchanged: game currency cannot be bought.

Payment is processed by the payment service provider Stripe. The contract for processing the payment is concluded between you and Stripe; Stripe's terms and privacy policy apply there. The operator receives no card details and stores none. Your username is passed on as a reference so that the payment can be matched to your account.

A donation is a one off, gratuitous contribution without consideration. Once payment has been made there is no claim to a refund. Anyone who mistypes or pays by accident should get in touch via the contact address in section 13; a repayment is then decided as a gesture of goodwill.

As a thank you, the operator may grant the Supporter badge. It is purely cosmetic, has no effect whatsoever on the game and is set by hand, which can take a few days. There is no legal claim to the badge, and it may be withdrawn in cases of misuse or if the badge system changes.
