1. Who is writing this

There is no company and no team behind Volley Vendetta, only one person. I develop and operate this game in my free time, alongside a job and everyday life, with no staff, no investors and no support department.

That has consequences, and I would rather write them down plainly than dress them up. There will be bugs. There will be waiting times when you write to me. There will be moments when something is broken and stays broken for hours, because I am asleep or at work. Please be generous about that. If you find a bug, report it instead of exploiting it. If something is missing, tell me instead of telling everyone else. This project lives on the people who use it wanting to make it better.

In return: I take every report seriously, I answer every request, and I do not hide behind a form with nobody at the other end. The address in the imprint is genuinely mine, and whatever you write into the form below reaches me directly.

2. Images you upload

Volley Vendetta lets you upload your own images, for example as a team logo, a profile picture or the artwork on your player card. For the game to be allowed to display those images at all, I need your permission. You grant that permission the moment you upload an image.

Specifically, you grant me the royalty-free, worldwide, perpetual, transferable and sublicensable right to store, reproduce, edit and make publicly available the uploaded image as part of operating the game. This expressly includes: displaying it to all other users of the game, resizing, cropping and cutting it out from its background, embedding it into player cards and other views, keeping it in backups, and using it in announcements and in promoting the game itself, for instance on social networks or on the home page.

No claim to payment arises from this use, neither now nor later. The game is free, and no money is made from your image.

You can replace or delete an uploaded image yourself at any time, which ends the permission going forward. Whatever has already been spread elsewhere by that point is beyond my reach. Section 4 is about exactly that.

3. What you are confirming

With every image you upload, you confirm two things to me.

First, that you hold the necessary rights to that image. An image from a search engine, a team photo taken by the club photographer, a still from a television broadcast or an image owned by a picture agency does not qualify, not even if it was freely findable online.

Second, that no other identifiable person appears in the image without having agreed to it. If you upload a teammate, a coach or an entire squad, you need their consent. If a depicted person is a minor, you need the consent of their legal guardians.

If someone raises claims against me because of an image you uploaded, you indemnify me against those claims and bear the cost of a reasonable legal defence. That is not a threat but a plain division of responsibility: I cannot verify where an image comes from. You know.

I reserve the right to remove images without prior notice if there is reasonable suspicion that rights are being infringed, or if an image is abusive, glorifies violence, is pornographic or is otherwise plainly inappropriate.

4. What I cannot prevent

Every image displayed in a browser has already arrived on the viewer's device. It can be saved, photographed, captured as a screenshot, forwarded and uploaded again somewhere else. There is no technical measure that genuinely prevents this. Watermarks, disabled right-clicks and similar tricks stop nobody who is determined. I therefore do not use them at all, rather than pretending to offer a safety that does not exist.

Put plainly: once you upload an image, other users can see it, and what they do with it afterwards is outside my control. To the extent permitted by law I accept no liability for the acts of third parties, in particular not for the copying, redistribution or alteration of images by other users or by people outside the game. Liability on my part for intent and gross negligence remains unaffected, as does any mandatory statutory liability.

My advice, as dry as it sounds: only upload images whose redistribution you could live with in the worst case. A volleyball game in a browser does not need a photo you would be uncomfortable seeing turn up elsewhere.

If something does happen to you, for instance because someone misuses your image taken from the game, report it to me anyway. I can suspend the account, remove the image and give you everything I have so you can pursue the case. I cannot prevent it, but I will not leave you alone with it either.

5. Real people in the game

Volley Vendetta depicts real volleyball players. Names, positions, nationalities and in some cases photographs come from publicly accessible sources such as federation and club websites, squad lists and freely available image libraries.

This calls for a clear statement: there is no affiliation, no partnership and no endorsement by federations, leagues, clubs, agencies or the depicted people themselves. Volley Vendetta is a private fan project, not an official product, and it earns no money from this data. All trademarks, club names and competition names belong to their respective owners.

And now the part that matters.

6. No profit, and one large goal

Volley Vendetta is not run for profit. There is no advertising, no paid feature, no sale of in-game currency, and no sharing or selling of user data. The cash used in the game is purely a game currency with no real-world value; it can neither be bought nor paid out. I cover the running costs myself.

Why I do this: volleyball is scattered across many countries, leagues, federations and platforms, and there is no single place where it all comes together. My goal is to build exactly that place. One world in which managers from Switzerland, Poland, Italy and Turkey compete inside the same system, with the same players, in the same pyramid.

Part of that is not handing this project over. I do not intend to sell it, to pass it to an investor, or to hand on the data of the people who use it.

That is an intention, not a guarantee, and I deliberately do not word it any more strongly. Should the model ever change, for instance because server costs outgrow what I can carry, I will announce it here and in the news section before it takes effect.

7. Scope, language version and changes

This disclaimer supplements the terms of use and the privacy policy and forms part of the terms of use. Where this page and the terms of use conflict, whichever provision is more favourable to you applies.

The German version is authoritative. Translations into other languages are provided for ease of understanding and do not create any differing rights or obligations.

Should any provision of this disclaimer be or become wholly or partly invalid, the validity of the remaining provisions is unaffected. The statutory rule takes the place of the invalid provision.

I may adjust this text when new features arrive or the legal situation changes. The version published here is the one that applies. Swiss law governs; mandatory consumer protection provisions of your country of residence remain unaffected.
